Key Laws Every Investigator Must Know

These federal and state laws apply across multiple industry verticals. Understanding them is not optional - it is the foundation of operating legally and professionally.

Privacy Act 1988 (Cth)

Governs the collection, use, storage, and disclosure of personal information. The 13 Australian Privacy Principles (APPs) apply to all investigators, skip tracers, and debt collectors handling personal data.

Australian Consumer Law (ACL)

Part of the Competition and Consumer Act 2010. Prohibits misleading conduct, unconscionable behaviour, and unfair practices. Critical for debt collectors and lost funds service providers.

NCCP Act 2009

The National Consumer Credit Protection Act regulates credit providers and debt collectors dealing with consumer credit. Requires an Australian Credit Licence for certain debt management activities.

Surveillance Devices Acts

Each state and territory has its own Surveillance Devices Act. These laws govern the use of listening devices, optical surveillance, tracking devices, and data surveillance. Breaches carry serious criminal penalties.

Security Industry Acts

State-based legislation governing the licensing of private investigators, security guards, and related roles. Each state has its own act, regulator, and licensing requirements.

Criminal Code Act 1995 (Cth)

Unauthorised access to computer systems or databases is a federal criminal offence. Investigators must only access data through lawful, authorised channels.

Frequently Asked Questions

Quick answers to the most common questions about Australia's investigative industries.

Yes, in most states and territories. NSW, QLD, VIC, WA, SA, and ACT all require a licence. The NT and TAS have different arrangements. Requirements include completing a Certificate III in Investigative Services, passing a criminal history check, and applying to the relevant state regulator. See our Private Investigations guide for full state-by-state details.
Yes, skip tracing is legal in Australia when conducted lawfully. Practitioners must comply with the Privacy Act 1988, only access data through authorised channels, and not use surveillance devices without consent. Licensed investigators have broader access to certain data sources. See our Skip Tracing guide for full details.
It depends on the type of debt collection. General debt collection does not require a specific licence in most states, but debt management services (helping consumers manage their debts) require an Australian Credit Licence from ASIC. All debt collectors must comply with the ACCC/ASIC Debt Collection Guideline and the Australian Consumer Law. See our Debt Collection guide.
ASIC's Moneysmart website has a free unclaimed money search covering bank accounts and life insurance policies. The ATO holds lost superannuation. Each state and territory also has its own unclaimed money register. See our Lost Funds guide for a complete list of all registers and how to search them.
